Waiver - Modo Yoga Barrie

All sales are final. No transfers. Please check expiry on class packages/credits. No extensions. Unlimited memberships are not shareable. You can reserve for a guest using your class credit package.

Minimum age 16 years old accompanied by a guardian 18 and over.

CLASS RESERVATION AND CANCELLATION POLICY:
We highly recommend you pre-register for class online to guarantee your spot.

Members: A 3 hour cancellation notice is required and must be done through the online system to avoid any and all late charges. No phone cancellations please. There are two types of cancellation charges, “Late Cancel” ($10 Charge) and “No Show” ($20 Charge).

Class Card Holders: If you are using a class card, the class will be deducted from your class card if you do not cancel 3 hours prior to the start time of class or do not show up for a reserved class.

I AGREE TO THE FOLLOWING:

I acknowledge that the instruction offered by Modo Yoga Barrie is limited to that of instruction in various forms of yoga, pilates, barre, HIIT, and fitness training in a heated climate.

• I acknowledge that there are risks associated with participation in the activities and programs offered or sponsored by Modo Yoga Barrie. I have informed myself and understand the risks associated with my participation in these activities and programs and (where applicable) my use of the facilities, including the risk of personal injury, and I freely accept these risks.

• I understand that I am free to withdraw from or reduce my participation in the activities and programs offered or sponsored by Modo Yoga Barrie at any time.

• I represent and warrant that I am physically fit, and I am not aware of any medical condition(s) that would affect my ability to participate in the activities and programs offered or sponsored by Modo Yoga Barrie. If I have any concerns about my medical condition, then I will consult with my physician before participating in the activities and programs offered or sponsored by Modo Yoga Barrie.

• I warrant that I have not, within the past 7 days, experienced symptoms of a communicable disease, nor have I been in close contact with anyone suspected to have symptoms. I will update Modo Yoga Barrie as to any changes in my medical condition and notify you in the event I am diagnosed with a communicable disease. I accept that participation in exercise classes has risks of contracting a communicable disease, and I am aware of and accept those risks and release Modo Yoga Barrie from any liability related thereto.

• Surgery Policy: If I am less than 6 weeks post-surgery, then I will provide a doctor’s note to Modo Yoga Barrie before participating in any class.

• Media Release: By participating in any class, I grant Modo Yoga Barrie the irrevocable right to use my image (photo, video, audio recording, social media posts via my own or others posting of me) as part of studio marketing and in perpetuity. I will advise Modo Yoga Barrie if I do not want my image used.

In consideration of the acceptance of my registration for the activities and programs offered or sponsored by Modo Yoga Barrie, I hereby for myself, my heirs, executors, administrators, or any others who may claim on my behalf, promise not to sue, and hereby waive, release and discharge Modo Yoga Barrie and anyone acting for or on its behalf, from any and all claims of liability for personal injury, illness, loss of life or property damage of any kind or nature, arising out of or sustained in the course of my participation in the activities and programs offered or sponsored by Modo Yoga Barrie or attending Modo Yoga-related events both on and off of the Modo Yoga Barrie Premises. This Release and Waiver applies to all claims, foreseen or unforeseen, including negligence and breach of statutory or other duty of care (including that owed under The Occupier’s Liability Act).

I agree that Modo Yoga Barrie is not responsible in the event of loss, damage, unauthorized use, theft, or injury resulting from and to any personal property that I bring onto the premises.
