Terms of Service

Payment

  • Taxes are not included in advertised prices.
  • All payments are processed via your online account. We accept payment by debit, Visa and MasterCard.

Refunds & Exchanges

  • All forms of membership sales are non-refundable and non-transferable.
  • Retail items are eligible for a return within 10 business days, or for an exchange or store credit within 30 days. Items must be unused and in its original packaging.
  • To complete your exchange or store credit, we require a receipt or proof of purchase.

Memberships

Standard & Premium Membership [Auto Renew]

 Activation date

    • Your Unlimited Auto renew activates and gets billed on the date of your first visit. Please ensure that your credit card is current.

 

Conditions

    • This is a no commitment, recurring monthly auto-renew membership. This pass can be used for all classes on our regular schedule – excluding karma classes, special events and workshops. This membership has no extensions, is non-transferable and non-refundable.
    • Membership may be subject to an annual 5% price increase. 

 

Perks

    • Share your practice and introduce your friends and family to yoga. Standard and Premium Memberships get 2 guest passes per billing cycle – guest passes are for new and returning students.
    • Free access to Modo Yoga Online (on demand classes).
    • Discounts at neighboring retailers ($25 off membership at Rally Pickleball, 15% off at Il Fornello, Bottega & Café Alba)

Suspension

    • Standard and Premium Memberships can request 2 holds per calendar year on their membership.
    • Holds can be placed for a maximum of 90 days.
    • Suspension requests must be submitted in writing at least three business days in advance of the suspension period-start date, by filling out a request form on our website (under Membership Services).
    • Medical suspensions require a doctor’s note and clearance to return.

 

Cancellation

    • Cancellation requests require 30 days notice and must be submitted by filling out a request form on our website (under Membership Services).
    • Please note that you cannot sign back onto membership at the current rate once cancelled. 

Annual Membership

Activation date

    • Your Annual Membership activates and gets billed on the date of your first visit.

 

Conditions

    • This pass can be used for all classes on our regular schedule – excluding karma classes, special events and workshops. This membership has no extensions, is non-transferable and non-refundable.
    • Membership may be subject to an annual 5% price increase.

    • Free access to Modo Yoga Online (on demand classes).

Intro Month Membership

Activation date

    • Your Intro Month Membership activates on the date of your first class.

 

Conditions

    • This membership can be used only at Modo Yoga Erin Mills for all classes on our regular schedule, excluding karma classes, special events and workshops.
    • This membership is non-transferable and does not allow suspensions or extensions.

 

Suspension

    • Your Intro Month Membership cannot be suspended, extended or transferred.
    • Medical suspension requests require a doctor’s note and clearance to return

 

Guest Passes

    • Share your practice and introduce your friends and family to yoga. 
    • Intro Month Membership gets 2 guest passes.
    • Guest passes are for new guests only.

 

Class Credit Packages

 Activation date

    • Credit Packages activate on the date of purchase.

 

Expiration date

    • Credit packages expire 12 months from date of purchase -unless otherwise stated on promotional offers.

 

Conditions

    • Credit packages can be used only at Modo Yoga Erin Mills for all classes on our regular schedule, excluding karma classes, special events and workshops.
    • Credit packages have no holds, extensions and are non transferrable.

 

Guest passes

  • Share your practice and introduce your friends and family to your community, use your credit package to bring a guest.

 

Workshops and Events

  • Pre-registration is required for workshops and events.
  • All workshops must be paid in full before the day of the event. Unpaid registrations risk being removed from the workshop without notice if it becomes full.
  • Workshop cancellation requests must be received via email a minimum of 48 hours in advance of the workshop.
  • Workshop registration fees will be returned to your Modo account as balance and are not refundable.

Promotions

  • Periodically, promotions will be emailed to our students and/or advertised via social media. Typically, these promotions are available for a short duration.
  • Once the stated deadline for purchase is over, we are no longer able to honor the promotion.
  • Be sure to note expiry dates on promotions as they may vary from regularly priced offerings.
  • If you purchase a promotional class card, it will have an expiration date of 6 months. If the class card expires before all classes have been used, you will receive a 30-day extension and if classes are not used up by then, you will receive the value of what you paid. 

 

Class Registration

  • While it is not always necessary, we advise online pre-registration for all classes and workshops to secure your spot.
  • You can make your class reservations 7 DAYS IN ADVANCE via the app or website- from your account associated with your email. 
  • We do not take pre-registrations by phone or email.
  • Students experiencing issues with their online account can send us a detailed description of the problem and we’ll try to remedy the problem together!

 

Waitlist

  • We understand that waiting lists can feel frustrating at times, but you must trust the process! Space almost always opens up — usually, not until the same day as class
  • Even when a class appears full, you may, and should, add yourself to the waitlist.
  • When a cancellation is made, the first name on the waitlist gets automatically added to the class.
  • If you are signed up for notifications, you will receive an email and text as soon as you are moved off the waitlist.
  • Once you are added to the class from the waitlist, you become responsible for attending or canceling like any other reservation.
  • If you are on the waitlist and know you do not plan to come to class, make sure to remove yourself before being added without adequate time to plan ahead or cancel without penalty (less than 30 minutes before class).
  • If you are booked for class, your spot is held up until 5 minutes before class. At 5 minutes before class, any student who has not checked in for class will risk losing their spot to someone who is present from the waitlist.
  • We understand how frustrating this can be—to avoid losing your spot, arrive early (5 minutes or more) and be ready to go!
  • Make sure you have an active payment on your account for every wait list spot you reserve — if your spot is unpaid and room on the waiting list opens up, your place can’t be guaranteed until paid for.

Cancellation

  • We understand that last minute things come up, and that schedules can change. Out of respect for fellow members and class capacity restrictions, be sure to cancel your reservation if you can no longer make it. This makes room for another member and avoids penalty fees.
  • Cancel your reservation directly from your account- on the app, or website, up to 30 MINUTES IN ADVANCE to avoid penalty fees. 

 

Penalty Fees

Late Cancellation

    • Canceling reservation less than 30 min before class: Charged a $10 late cancel fee.

 

No Show

    • You do not show up to class: Charged a $20 no show penalty fee.

 

Guest Booking

  • Standard and Premium Members get 2 guest passes every billing cycle.
  • Annual Memberships get 24 guest passes per year.
  • Class Card holders and Drop-In students may use credits on their account to register friends and family.
  • Guests can be booked through our app or website. Simply select “Reserve for Guest” and enter their email address. MYEM students do not need to be present in person with their guests but are responsible for all policies and fees attached to the reservation.
  • Guests are required to create an account and fill out a waiver prior to attending class.

 

Notifications

  • Turn on your text alerts! This is the best way to confirm your spot, it’s automatic. If you answer the text, you do not need to respond to the email. We love hearing from you, but when you confirm by email, your reservation has to be updated manually. Text confirmations are instant and ensure that you won’t lose your spot.

Storage Onsite and Lost & Found

  • Modo Yoga Erin Mills does not provide space for students to store their personal belongings or their mat,
  • Modo Yoga Erin Mills is not responsible for the loss or theft of personal belongings.
  • Any personal items that are found in the studio will be lovingly placed in our Lost & Found.
  • Unclaimed Lost & Found items are donated to charity at the end of each month.

Minimum Age policy for Hot Yoga at Modo Yoga

  • In order to respect our insurance policy and to ensure everyone’s safety, the following are approved of 1-hour hot yoga classes:
    • 16 and up unaccompanied
    • 12-16 years old accompanied by an adult (parent or guardian) only

AGREEMENT OF RELEASE AND WAIVER

I, hereby agree to the following:

  • I am fully aware of the risks and hazards involved in practicing yoga and yoga-related modalities at Modo Yoga Erin Mills, including in a heated climate.
  • I understand that it is my responsibility to consult with a physician prior to and regarding my participation in group or private heated yoga classes, workshops, and retreats offered by Modo Yoga Erin Mills.
  • I represent and warrant that I am physically fit and I have no medical condition(s) that would prevent my full participation in group or private yoga classes, workshops and retreats offered by Modo Yoga Erin Mills.
  • I will update Modo Yoga Erin Mills as to any changes in my medical condition.
  • I will not enter the Modo Yoga Erin Mills premises or participate in any yoga classes, workshops, and retreats offered by Modo Yoga Erin Mills if I am feeling sick.
  • In consideration for being permitted to participate in group or private yoga classes, workshops and retreats provided by Modo Yoga Erin Mills, I agree to assume full responsibility and, on behalf of myself and, to the extent permitted law, my spouse, heirs, executors, administrators, assigns, and other persons or entities acting or purporting to act on my behalf, hereby generally and completely release, acquit, and forever discharge and release Modo Yoga Erin Mills, its owners, officers, directors, employees, instructors and representatives (the Modo Yoga Erin Mills parties) from any and all liability for any risks, illnesses, injuries or damages, known or unknown, which I might incur as a result of my participation. In further consideration thereof, I knowingly, voluntarily and expressly waive any claim I may have against the Modo Yoga Erin Mills parties for any illnesses, injury or damages that I may sustain as a result of my participation.
  • I will not engage in any inappropriate conduct or conduct which is in violation of this Agreement of Release and Waiver which could result in injury or illness to myself or others.
  • In further consideration of my participation in classes offered by Modo Yoga Erin Mills, I hereby release the Modo Yoga Erin Mills parties from any and all liability related to any loss, theft or damage of any of my personal property from the Modo Yoga Erin Mills premises.
  • I agree that this Agreement of Release and Waiver shall be governed by the laws of Erin Mills and if any conflict arises between me and Modo Yoga Erin Mills, I will attempt to resolve the conflict in good faith through mediation before submitting my dispute to binding arbitration.
  • I acknowledge that Modo Yoga Erin Mills is an independently owned and operated franchisee of Modo Yoga International, Inc.
    I have read the above release and waiver of liability and fully understand its contents and voluntarily agree to all of the terms and conditions.
