I acknowledge that the instruction offered by Modo Yoga Etobicoke is limited to that of instruction in basic yoga, pilates and fitness training in a heated climate, which may also involve the use of equipment.

• I acknowledge that there are risks associated with participation in the activities and programs offered or sponsored by Modo Yoga Etobicoke. I have informed myself and understand the risks associated with my participation in these activities and programs and (where applicable) my use of the facilities, including the risk of personal injury, and I freely accept these risks.

• I understand that I am free to withdraw from or reduce my participation in the activities and programs offered or sponsored by Modo Yoga Etobicoke at any time.

• I represent and warrant that I am physically fit, and I am not aware of any medical condition(s) that would affect my ability to participate in the activities and programs offered or sponsored by Modo Yoga Etobicoke. If I have any concerns about my medical condition, then I will consult with my physician before participating in the activities and programs offered or sponsored by Modo Yoga Etobicoke.

• I warrant that I have not, within the past 14 days, experienced symptoms of a communicable disease or coronavirus (Covid-19), nor have I been in close contact with anyone suspected to have symptoms. I will update Modo Yoga Etobicoke as to any changes in my medical condition and notify you in the event I am diagnosed with a communicable disease or Covid-19. I agree to wear a mask upon entering the studio/premises and to comply with public health guidelines and studio policies on health and safety. At the same time, I understand that participation in exercise classes has risks of contracting a communicable disease or Covid-19 and I accept those risks and release Modo Yoga Etobicoke from any liability related thereto.

• Surgery Policy: If I am less than 6 weeks post-surgery, then I will provide a doctor’s note to Modo Yoga Etobicoke before participating in any class.

• Media Release: By participating in any class, I grant Modo Yoga Etobicoke the irrevocable right to use my image (photo, video, audio recording, social media posts via my own or others posting of me) as part of studio marketing and sales in perpetuity. I will advise Modo Yoga Etobicoke if I do not want my image used.

In consideration of the acceptance of my registration for the activities and programs offered or sponsored by Modo Yoga Etobicoke, I hereby for myself, my heirs, executors, administrators, or any others who may claim on my behalf, promise not to sue, and hereby waive, release and discharge Modo Yoga Etobicoke and anyone acting for or on its behalf, from any and all claims of liability for personal injury, illness, loss of life or property damage of any kind or nature, including as a result of Modo Yoga Etobicoke’s negligence, arising out of or sustained in the course of my participation in the activities and programs offered or sponsored by Modo Yoga Etobicoke or attending Modo Yoga-related events both on and off of the Modo Yoga Etobicoke Premises. This Release and Waiver applies to all claims, foreseen or unforeseen, including negligence and breach of statutory or other duty of care (including that owed under The Occupier’s Liability Act).

I agree that Modo Yoga Etobicoke is not responsible in the event of loss, damage, unauthorized use, theft, or injury resulting from and to any personal property that I bring onto the premises.

I agree that this Agreement and Release and Waiver is intended to be as broad and inclusive as permitted by law. Any provision found to be invalid or unenforceable by a court shall not affect the validity or enforceability of any other provision.

I have read this document carefully and acknowledge that I have complete knowledge and understanding of its contents. I recognize that by signing this document I am waiving certain legal rights, including the right to sue. I am signing this document voluntarily.

*Modo Yoga Etobicoke means Follow Your Bliss Inc., its officers, directors, shareholders, employees, contractors and instructors.

I have read this agreement and fully understand its content and meaning, voluntarily agree to all of the terms & conditions, sign it of my own free will and I am over the age of 18.
