AWARENESS OF RISKS

• I acknowledge that the instruction offered by Modo Yoga Maple is limited to that of instruction in basic yoga, pilates, barre and fitness training in a heated climate.

• I acknowledge that there are risks associated with participation in the activities and programs offered or sponsored by Modo Yoga Maple. I have informed myself and understand the risks associated with my participation in these activities and programs and (where applicable) my use of the facilities, including the risk of personal injury, and I freely accept these risks.

• I understand that I am free to withdraw from or reduce my participation in the activities and programs offered or sponsored by Modo Yoga Maple at any time.

• I represent and warrant that I am physically fit, and I am not aware of any medical condition(s) that would affect my ability to participate in the activities and programs offered or sponsored by Modo Yoga Maple. If I have any concerns about my medical condition, then I will consult with my physician before participating in the activities and programs offered or sponsored by Modo Yoga Maple.

• I warrant that I have not, within the past 14 days, experienced symptoms of a communicable disease or coronavirus (Covid-19), nor have I been in close contact with anyone suspected to have symptoms. I will update Modo Yoga Maple as to any changes in my medical condition and notify you in the event I am diagnosed with a communicable disease or Covid-19. I accept that participation in exercise classes has risks of contracting a communicable disease or Covid-19, and I am aware of and accept those risks and release Modo Yoga Maple from any liability related thereto.

• Surgery Policy: If I am less than 6 weeks post-surgery, then I will provide a doctor’s note to Modo Yoga Maple before participating in any class.

• Media Release: By participating in any class, I grant Modo Yoga Maple the irrevocable right to use my image (photo, video, audio recording, social media posts via my own or others posting of me) as part of studio marketing and in perpetuity. I will advise Modo Yoga Maple if I do not want my image used.

In consideration of the acceptance of my registration for the activities and programs offered or sponsored by Modo Yoga Maple, I hereby for myself, my heirs, executors, administrators, or any others who may claim on my behalf, promise not to sue, and hereby waive, release and discharge Modo Yoga Maple and anyone acting for or on its behalf, from any and all claims of liability for personal injury, illness, loss of life or property damage of any kind or nature, arising out of or sustained in the course of my participation in the activities and programs offered or sponsored by Modo Yoga Maple or attending Modo Yoga-related events both on and off of the Modo Yoga Maple Premises. This Release and Waiver applies to all claims, foreseen or unforeseen, including negligence and breach of statutory or other duty of care (including that owed under The Occupier’s Liability Act).

I agree that Modo Yoga Maple is not responsible in the event of loss, damage, unauthorized use, theft, or injury resulting from and to any personal property that I bring onto the premises.

*If between the ages of 16-17 years, a legal guardian must consent to the conditions and terms and sign an additional release and waiver on behalf of the participant.
