PLEASE NOTE THAT A PLACE FOR ALL INC. IS DOING BUSINESS AS MODO YOGA NEWMARKET. We will refer to A Place For All Inc., a corporation registered in the Province of Ontario, as “Modo Yoga Newmarket”, and we’ll refer to you, the undersigned (electronically or by hand) or person who has clicked “I Agree” to this Waiver, as “I” or “me” or “myself”.
I hereby agree to the following:
I understand that yoga is not a substitute for medical attention and it is not intended to examine, diagnose or treat any condition. I acknowledge that yoga, and exercise classes are not recommended and are not safe for those with certain medical conditions.
I am fully aware of the risks and hazards involved in practicing yoga, yoga-related modalities and exercise classes at Modo Yoga Newmarket. I understand that group or private yoga classes, exercise classes, workshops, and retreats may include stretching, strengthening, balancing and breathing in a heated environment. I further understand that the above may include the use of yoga props, resistance bands and balls, dumbbells, foam rollers, massage balls and hands-on assists.
I represent that I am competent to decide for myself whether or not to participate in group or private yoga classes, exercise classes, workshops and retreats offered by Modo Yoga Newmarket and I will make an informed choice before doing so.
I represent and warrant that I am physically fit and I have no medical condition(s) that would prevent my full participation in group or private yoga classes, exercise classes, workshops and retreats offered by Modo Yoga Newmarket.
I acknowledge that it is my responsibility to consult with a physician prior to and regarding my participation in group or private heated yoga classes, exercise classes, workshops, and retreats offered by Modo Yoga Newmarket.
I understand my physical limitations and am sufficiently self-aware to stop or modify my involvement in group or private yoga classes, exercise classes, workshops and retreats offered by Modo Yoga Newmarket.
I will not enter the Modo Yoga Newmarket premises if I am experiencing any sign of illness, including, without limitation, fever, chills, cough, shortness of breath, or sore throat.
In consideration for being permitted to participate in group or private yoga classes, exercises classes, workshops and retreats provided by Modo Yoga Newmarket, I agree to assume full responsibility and, on behalf of myself and, to the extent permitted law, my spouse, heirs, executors, administrators, assigns, and other persons or entities acting or purporting to act on my behalf, hereby generally and completely release, acquit, and forever discharge and release Modo Yoga Newmarket, its owners, officers, directors, employees, instructors, and representatives (the Modo Yoga Newmarket parties) from any and all liability for any risks, illnesses, injuries or damages, known or unknown, which I might incur as a result of my participation. In further consideration thereof, I knowingly, voluntarily and expressly waive any claim I may have against the Modo Yoga Newmarket parties for any illnesses, injury or damages that I may sustain as a result of my participation.
I will not engage in any inappropriate conduct or conduct which is in violation of this Agreement of Release and Waiver which could result in injury or illness to myself or others.
In further consideration of my participation in classes offered by Modo Yoga Newmarket, I hereby release the Modo Yoga Newmarket parties from any and all liability related to any loss, theft or damage of any of my personal property from the Modo Yoga Newmarket premises.
I agree that Modo Yoga Newmarket may photograph, video, or otherwise record classes and may place such photographs, videos and recordings on its website or social media platform. I expressly consent to the use of my image in any such photograph, video or recording.
I agree that this Agreement of Release and Waiver shall be governed by the laws of the Province of Ontario and if any conflict arises between me and Modo Yoga Newmarket, I will attempt to resolve the conflict in good faith through mediation before submitting my dispute to binding arbitration.
I understand that Modo Yoga Newmarket is an independently owned and operated franchisee of Modo Yoga International, Inc.
I have read the above release and waiver of liability and fully understand its contents and voluntarily agree to all of the terms and conditions. By checking the box/signing below, I AGREE THAT I AM SIGNING AWAY MY LEGAL RIGHTS AND I AGREE TO BE BOUND BY ALL THE TERMS OF THIS AGREEMENT.
