CONTRAT DE SERVICE ET D’EXONÉRATION DE RESPONSABILITÉ

Terms of Service

Je, [NOM DU CLIENT], consens par la présente à ce qui suit :

1. Je suis pleinement conscient(e) des risques et dangers liés à la pratique du yoga et des modalités associées au yoga à Modo Yoga Ouest-de-l’Île, y compris dans un climat chauffé.

2. Je comprends que si j’ai des problèmes de santé, il est de ma responsabilité de consulter un médecin avant et concernant ma participation à des cours de yoga chauffés en groupe ou en privé, à des ateliers et à des retraites offerts par Modo Yoga Ouest-de-l’Île.

3. Je renonce volontairement et expressément à toute réclamation que je pourrais avoir contre les parties de Modo Yoga West Island pour toute maladie, blessure ou dommage que je pourrais subir en raison de ma participation. En contrepartie de l’autorisation de participer aux cours de yoga en groupe ou en privé, aux ateliers et aux retraites offerts par Modo Yoga West Island, je consens à assumer l’entière responsabilité et, en mon nom et, dans la mesure permise par la loi, en celui de mon conjoint, de mes héritiers, de mes exécuteurs testamentaires, de mes administrateurs, de mes ayants droit et des autres personnes ou entités agissant ou prétendant agir en mon nom, libère, acquitte et décharge à jamais Modo Yoga West Island, ses propriétaires, dirigeants, administrateurs, employés, instructeurs et représentants (les parties de Modo Yoga West Island) de toute responsabilité pour les risques, maladies, blessures ou dommages, connus ou inconnus, que je pourrais encourir à la suite de ma participation.

4. Je ne m’engagerai pas dans un comportement inapproprié ou en violation du présent accord de décharge et de renonciation, qui pourrait entraîner des blessures ou des maladies pour moi-même ou pour d’autres personnes.

5. Je dégage les parties de Modo Yoga West Island de toute responsabilité liée à la perte, au vol ou à l’endommagement de mes biens personnels sur les lieux.

6. Je consens à ce que cette entente de décharge et de renonciation soit régie par les lois du Québec, Canada, et si un conflit survient entre moi et Modo Yoga West Island, je tenterai de résoudre le conflit de bonne foi par la médiation avant de soumettre mon désaccord à un arbitrage exécutoire.

7. J’ai lu la décharge et l’exonération de responsabilité ci-dessus, j’en comprends pleinement le contenu et j’en consens volontairement à tous les termes et conditions.

I, [CLIENT NAME] hereby agree to the following:

1. I am fully aware of the risks and hazards involved in practicing yoga and yoga-related modalities at Modo Yoga West Island, including in a heated climate.

2. I understand that if I have any medical conditions, it is my responsibility to consult with a physician prior to and regarding my participation in group or private heated yoga classes, workshops, and retreats offered by Modo Yoga West Island.

3. I voluntarily and expressly waive any claim I may have against the Modo Yoga West Island parties for any illnesses, injury or damages that I may sustain due to my participation. In consideration for being permitted to participate in group or private yoga classes, workshops and retreats provided by Modo Yoga West Island, I agree to assume full responsibility and, on behalf of myself and, to the extent permitted by law, my spouse, heirs, executors, administrators, assigns, and other persons or entities acting or purporting to act on my behalf, hereby generally and completely release, acquit, and forever discharge and release Modo Yoga West Island, its owners, officers, directors, employees, instructors and representatives (the Modo Yoga West Island parties) from any and all liability for any risks, illnesses, injuries or damages, known or unknown, which I might incur as a result of my participation.

4. I will not engage in any inappropriate conduct or conduct which is in violation of this Agreement of Release and Waiver which could result in injury or illness to myself or others.

5. I release the Modo Yoga West Island parties from any and all liability related to any loss, theft or damage of any of my personal property from the premises.

6. I agree that this Agreement of Release and Waiver shall be governed by the laws of Quebec, Canada, and if any conflict arises between me and Modo Yoga West Island, I will attempt to resolve the conflict in good faith through mediation before submitting my dispute to binding arbitration.

7. I have read the above release and waiver of liability, fully understand its contents, and voluntarily agree to all of the terms and conditions.
